This Privacy Policy describes information that we may collect from you when you visit (the “Site”) or direct an inquiry to Giving Arts through electronic means. This Privacy Policy explains how Giving Arts stores, uses, discloses, or shares that information.

Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, do not access or use the site. By accessing or using the Site, you agree to this Privacy Policy. The Privacy Policy may change from time to time. Giving Arts will post the modified version at this same URL. Your continued use of the Site after the Privacy Policy has been modified is deemed to be an acceptance of those modifications.

This Privacy Policy does not apply to information collected by third parties including websites that may be linked to from this Site. Giving Arts is not responsible for the content or privacy practices of any non-Giving Arts website to which this site links.

1. Scope

  1. Use of the Site – This Privacy Policy applies to information collected when you use the Site and in electronic communications transmitted through the Site. It does not apply to information collected offline. In addition, this Privacy Policy does not apply to information collected by any third parties regardless of whether or not the Site includes links to the websites of those third parties.
  2. Purpose of the Site – Giving Arts is an Online Retail Store that sells Wall Art, Home Décor, Lifestyle Products, Stationery, and Apparel. We represent and sells Artists’ art and designs and art products featuring their work. We market and sell their work through Fundraiser Campaigns that support some of the largest Non-Profit Organizations in the United States. 

2. Information that we collect

Giving Arts collects personal information and non-personal information.

  1. Non-personal Information is any information that does not identify you individually or does not permit a direct association with an individual. Non-personal Information may include information derived from Personal Information that has been de-personalized by removing unique identifiers and/or by combining it with information about other users to form aggregated data.
  2. Personal Information is information that is reasonably capable of being associated with or could be linked, directly or indirectly, with a particular consumer or household.
  3. Examples of information Giving Arts collects include:
    1. Information you provide when you enter into an Artist Agreement with Giving Arts, or sign up for communications, including: your name, date of birth, mailing address, phone number, email address, username, and password
    2. Transaction information a customer provides when he/she make a purchase, such as your name, e-mail address, mailing address, telephone number, and payment information
    3. Information we obtain from third parties such as a third party websites, vendors, service providers, or other platform providers
    4. Location information including data provided by a mobile device or other device as you navigate our Site
    5. Activity information pertaining to your use of the Site

3. How we collect information

Giving Arts collects information from and about you, directly, when you provide such information to Giving Arts and, automatically, when you use the Site. 

  1. Information You Provide – Giving Arts collects information that you provide when you contact us via email or mobile device, complete a transaction, enter a promotion, sign up to receive communications, or set up an account on our site. The information collected may include anything submitted by you to the Site and may include copies of the correspondence. When you purchase goods through the Site, you voluntarily provide certain Personal Information which is stored by Giving Arts and also processed by a third-party company (i.e. our credit card processors). If you voluntarily provide your Personal Information to us, we collect it. You choose whether to disclose Personal Information, but you may not be able to use the Site or conduct certain transactions without doing so.
  2. Information Collected Automatically – When you visit or otherwise use the Site, Giving Arts collects details about your access and use of the Site automatically through cookies and other technology, including details about your device, internet connection, operating system, browser type, browsing actions, and the resources that you access and use on the Site, other traffic data, and, location data. The information Giving Arts collects automatically may include personal information or Giving Arts may associate it with personal information it collects in other ways or receives from third parties. If Giving Arts associates such data with personal information, Giving Arts will treat it as personal information, but if such data is not associated with other personal information, Giving Arts will treat it as non-personal information.

Giving Arts may use the technologies listed below to collect data as you visit the Site.

Giving Arts may aggregate the information you provide or that Giving Arts collects from you with information collected from other users to allow Giving Arts to evaluate its products and services. Giving Arts may use the information it collects to contact you about Giving Arts’ products and services that may interest you, and if required by law, we will obtain your approval to do so.

Giving Arts may disclose personal information that it collects from you or that you provide to us as described in this Privacy Policy to our business partners, affiliates, contractors, distributors, service providers, and other third parties that Giving Arts uses to support its business; to a purchaser or successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets; to fulfill the purpose for which you provided the personal information; for any other purpose when you consent to such disclosure at the time you provide the information. Giving Arts may also disclose your personal information to comply with any court order, law, or legal process, including to respond to any government or regulatory request, to enforce our terms of use and other agreements, and if Giving Arts believes disclosure is necessary or appropriate to protect the rights, property, or safety of Giving Arts, its customers, or others.
  2. Google Analytics – The Site uses Google Analytics. Google Analytics assists Giving Arts with collecting and monitoring data about traffic to the Site. 7. Your choices

  1. Do Not Track – Our Site does not respond to web browser Do Not Track (DNT) signals.

  3. Updating Information – You may contact Giving Arts to request access to, correct, or delete certain personal information that you have provided to Giving Arts.   4. Withdraw Consent – If our ability to use your personal information depends on consent you have given, you may withdraw such consent.
  5. Restriction – You may request that Giving Arts restrict or suspend use of your personal information.
  6. Object – You may object to our use of your personal information to perform services you have not requested.
  7. Copies and Portability – You may request copies of your personal information that we possess in a structured, commonly used, and machine-readable format, and you may request that this be transmitted to another controller.
  8. Complaint – You may lodge a complaint with the supervising authority of your country.

9. Data transfer

Giving Arts stores your personal information in the United States. The privacy protections in the United States may not be the same as in your home country. If you are located in a country outside the United States and submit personal information to Giving Arts, you consent to the general use and disclosure of such information as provided in this Privacy Policy and to the transfer and/or storage of that information to the United States.

10. Data retention and security

  1. Data Retention – Giving Arts may store your personal information as long as you use our goods and service in order to provide you with such goods and services and for all legitimate business purposes. Giving Arts may store your personal information to the extent required to comply with our legal, accounting, and/or reporting requirements and to provide information about Giving Arts products or services that you may request. Additionally, Giving Arts may continue to store your personal information contained in standard backup systems. Upon your request, Giving Arts will delete or de-identify your personal information unless Giving Arts is legally required or allowed to maintain such personal information.
  2. Data Security – Giving Arts has implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the transmission of information via the internet is not completely secure. Giving Arts cannot guarantee the security of your personal information transmitted to or through the Site. Any transmission of personal information is at your own risk. Giving Arts is not responsible for circumvention of any privacy settings or security measures contained in the Site.

11. Changes in our privacy policy

Changes to the Privacy Policy will be posted on this page. If Giving Arts makes material changes to the way it treats users personal information, it may choose to notify you via email or through another means in addition to posting. The date the Privacy Policy was last revised appears at the top of the Privacy Policy. You are responsible for ensuring Giving Arts has a current email address for you and for periodically visiting the Site and the Privacy Policy to check for any changes.

12. Children

The Site is not for children. Giving Arts does not knowingly collect personal information from children under the age of 18 through the Site. If Giving Arts learns that it has collected or received such information, it will delete that information. If you believe we might have information from or about a child under the age of 18, please let us know by contacting us using immediately.
